Please read this agreement carefully before renting any surf equipment from SurfMilfontes. By signing this agreement, you agree to adhere to the terms and conditions outlined below.
Acknowledgment of Risks:
The Renter acknowledges that surfing and the use of surf equipment carry inherent risks and hazards, including but not limited to physical injury, drowning, and damage to the equipment. The Renter affirms that they are aware of and accept these risks as a condition of renting surf equipment.
Equipment Use and Care:
The Renter agrees to use the surf equipment responsibly and in accordance with all instructions and guidelines provided by SurfMilfontes. The Renter is responsible for any damage to or loss of the equipment during the rental period.
Physical Fitness and Health Disclosure:
The Renter certifies they are physically fit and capable of using the surf equipment without undue risk to their health or safety. The Renter has disclosed to SurfMilfontes any pre-existing medical conditions, injuries, or disabilities that could affect their ability to safely use the surf equipment.
Safety Equipment:
The Renter commits to using all safety gear and equipment recommended by SurfMilfontes throughout the duration of the rental period.
Liability Waiver and Indemnification:
Release and Waiver of Liability:
The Renter hereby releases, waives, and discharges SurfMilfontes, its instructors, employees, and affiliates from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by the Renter, or to any property belonging to the Renter, while using the rented surf equipment.
Personal Property: The Renter acknowledges that SurfMilfontes is not responsible for the loss or damage of personal property during the rental period.
Return of Equipment:
The Renter agrees to return the surf equipment to SurfMilfontes in the same condition as it was at the start of the rental period. Any damage or loss of equipment will be the responsibility of the Renter, who agrees to cover the cost of repair or replacement.
Release, Image, Video and Authorization Agreement
1. Grant of Rights:
The undersigned (hereinafter referred to as “Participant”) hereby grants to SurfMilfontes, including its affiliates, agents, successors, and assigns (collectively referred to as “the Company”), the irrevocable, perpetual, and unrestricted right and permission to capture, use, reproduce, publish, display, broadcast, and distribute any photographs, videos, and other forms of digital or physical media (collectively, “Media”) taken of the Participant, or in which the Participant may be included, during participation in surf lessons. This grant extends to all uses of the Media for purposes including, but not limited to, advertising, marketing, promotion, documentation, and any other related purpose, in any manner or medium, currently known or developed in the future, without any further approval from the Participant or any compensation thereof. The Company reserves the right to modify, alter, crop, or otherwise adjust the Media at its discretion.
2. Scope of Use:
The Participant acknowledges and agrees that the Media may be utilized globally in various media forms, including, but not limited to, print publications, online platforms, social media channels, digital advertisements, promotional materials, and educational resources. The Participant acknowledges that the Company has complete discretion over the display and use of any Media featuring the Participant in connection with any lawful activities of the Company.
3. Waiver of Approval:
The Participant waives any right to inspect or approve the final use of the Media, including any written copy that may accompany it. The Participant acknowledges that the Media may be edited, altered, or modified in any manner by the Company without further consent.
Privacy, Data Protection, and Marketing Communications:
4. Consent to Use Personal Data:
By signing this agreement, the Participant expressly consents to the collection, use, processing, and storage of personal data, including, but not limited to, name, email address, and any photographs or videos taken during surf lessons, by the Company for the purposes of promoting and marketing its services, educational content, or events, including sending emails, newsletters, and other promotional communications.
5. Confidentiality and Data Sharing:
The Participant acknowledges that the Company is committed to maintaining the privacy and security of personal information. The Company agrees not to share, sell, or disclose the Participant’s personal data to third parties for purposes unrelated to the Company’s services without explicit consent, except as required by law.
6. Opt-out Rights:
The Participant retains the right to opt-out of receiving marketing communications from the Company at any time. To exercise this right, the Participant must send a clear and unambiguous request to the Company through the designated opt-out mechanism provided in the communications.
7. Updates to Personal Information:
The Participant acknowledges the responsibility to inform the Company of any changes to personal information to ensure accuracy in records and communications.
Acceptance:
By selecting “I accept” below, the Participant acknowledges having read, fully understood, and agreed to the terms and conditions outlined in this participation agreement, including the image and video release and privacy and marketing sections, willingly and knowingly entering into this agreement with the Company.
Non-Acceptance:
By selecting “I don’t accept” below, Should the Participant not accept any part of this agreement, it is the Participant’s responsibility to communicate directly with the SurfMilfontes team before the commencement of the activities.
