Surf Lesson Participation Agreement  Acknowledgment of Risks: The Participant acknowledges that surfing is an activity that carries inherent risks and hazards, including but not limited to physical injury, drowning, and damage to personal property. The Participant affirms that they are aware of and accept these risks as a condition of participation.  Physical Fitness and Health Disclosure: The Participant certifies they are physically fit and capable of participating in surf lessons without undue risk to their health or safety. The Participant has disclosed to the Company any pre-existing medical conditions, injuries, or disabilities that could affect their participation in surf lessons.  Adherence to Instructions: The Participant agrees to follow all directions and instructions given by the Company's instructors during surf lessons. The Participant acknowledges that the Company reserves the right to alter, postpone, or cancel lessons due to adverse weather or ocean conditions to ensure safety.  CONDITIONS FOR MINORS: Participation of Minors: If the Participant is responsible for minors (children under the age of 18) participating in the lessons, the Participant confirms they are the legal guardian or possess the requisite authority to act on behalf of the minors. The Participant agrees to ensure the minors' compliance with all instructions and safety guidelines. HEALTH AND SAFETY PROTOCOLS: Health Certification: The Participant asserts they are in good health and free from any medical conditions that could interfere with their ability to safely participate in surf lessons.  Notification of Health Changes: The Participant agrees to inform the Company immediately of any changes in their health or medical condition that might affect their participation in the surf lessons.  Use of Safety Equipment: The Participant commits to wearing all safety gear and equipment provided by the Company throughout the duration of the surf lessons.  LIABILITY WAIVER AND INDEMNIFICATION: Release and Waiver of Liability: The Participant hereby releases, waives, and discharges the Company, its instructors, employees, and affiliates from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by the Participant, or to any property belonging to the Participant, while participating in surf lessons.  Personal Property: The Participant acknowledges that the Company is not responsible for the loss or damage of personal property during the surf lessons.  Medical Authorization: In the event of an emergency, the Participant authorizes the Company to secure emergency medical treatment on their behalf.  Acceptance: By selecting \"I accept\" below, the Participant acknowledges having read, fully understood, and agreed to the terms and conditions outlined in this participation agreement, including the image and video release and privacy and marketing sections, willingly and knowingly entering into this agreement with the Company. Surf Lesson Participation AgreementRelease, Image, Video and Authorization Agreement<br>1. Grant of Rights:The undersigned (hereinafter referred to as \"Participant\") hereby grants to SurfMilfontes, including its affiliates, agents, successors, and assigns (collectively referred to as \"the Company\"), the irrevocable, perpetual, and unrestricted right and permission to capture, use, reproduce, publish, display, broadcast, and distribute any photographs, videos, and other forms of digital or physical media (collectively, \"Media\") taken of the Participant, or in which the Participant may be included, during participation in surf lessons. This grant extends to all uses of the Media for purposes including, but not limited to, advertising, marketing, promotion, documentation, and any other related purpose, in any manner or medium, currently known or developed in the future, without any further approval from the Participant or any compensation thereof. The Company reserves the right to modify, alter, crop, or otherwise adjust the Media at its discretion.2. Scope of Use:The Participant acknowledges and agrees that the Media may be utilized globally in various media forms, including, but not limited to, print publications, online platforms, social media channels, digital advertisements, promotional materials, and educational resources. The Participant acknowledges that the Company has complete discretion over the display and use of any Media featuring the Participant in connection with any lawful activities of the Company.3. Waiver of Approval:The Participant waives any right to inspect or approve the final use of the Media, including any written copy that may accompany it. The Participant acknowledges that the Media may be edited, altered, or modified in any manner by the Company without further consent.Privacy, Data Protection, and Marketing Communications:4. Consent to Use Personal Data:By signing this agreement, the Participant expressly consents to the collection, use, processing, and storage of personal data, including, but not limited to, name, email address, and any photographs or videos taken during surf lessons, by the Company for the purposes of promoting and marketing its services, educational content, or events, including sending emails, newsletters, and other promotional communications.5. Confidentiality and Data Sharing:The Participant acknowledges that the Company is committed to maintaining the privacy and security of personal information. The Company agrees not to share, sell, or disclose the Participant's personal data to third parties for purposes unrelated to the Company's services without explicit consent, except as required by law.6. Opt-out Rights:The Participant retains the right to opt-out of receiving marketing communications from the Company at any time. To exercise this right, the Participant must send a clear and unambiguous request to the Company through the designated opt-out mechanism provided in the communications.7.
